Let's get to our first story and my inspiration for today. It's from my own crop to in a little bit, my apple fritter. Give me a little energy today. This story from DragonCon and not a surprise. Written by David Brown. A federal arbitrator recently ruled that a train engineer who was found to have had cannabis in his system did not need to face penalties because he was not impaired.

The locomotive engineer from Saskatchewan tested positive for THC in a urinalysis conducted on March 30th of 2022 after an incident where the engineer had failed to secure his train. Although an oral swab and breathalyzer were both negative. Urinalysis showed that he was positive for cannabis metabolites 53 nanograms per milliliter. The man's union brought the grievance to arbitration, arguing that since the man was not found to have been impaired, a penalty of a 30 day suspension and six months of random on the job testing was uncalled for.

The company, Canadian Pacific, Kansas City, argued that the random testing is appropriate for safety reasons given the dangerous nature of the work, even if no discipline is imposed, the man told company investigators at the time of testing that he had consumed a cannabis candy some 16.5 hours before his tour of duty. In his analysis, the arbitrator noted that urinalysis has repeatedly been found by arbitrators to be incapable of assessing when or in what quantity drugs were consumed and whether the employee was impaired because of this and because the engineer who had 28 years of seniority at the time of the incident showed no signs of impairment.

The arbitrator found him not to have been impaired as such. In a ruling posted on September 16th, federal arbitrator James Cameron ruled that the 30 day suspension be struck down, with the employee compensated for lost time. He also found that the six months of random testing was not warranted since he was not impaired and was therefore not in violation of company policy.

Another ruling posted on the same day by the same arbitrator, ruled that a subsequent termination of the same employee who had been found to have alcohol in his system following testing conducted under the initial six month random sampling penalty, was uncalled for. The locomotive engineer, John Downie of Sutherland, Saskatchewan, was dismissed from service by Canadian Pacific Kansas City on January 28th of 2023, after testing positive for alcohol December 5th of 2022.

The man's union argued that he was not actually impaired at the time of testing, nor had he intentionally violated company policy by consuming alcohol nearly a full day prior to his shift. Downie told company investigators at the time of his random sampling that he had consumed alcohol around 20 hours before the start of his next shift, accounting for the breath alcohol content screening at 0.051% blood alcohol content and subsequent lab confirmation positive at 0.046%.

Company policy based on his previous suspension and six months of random testing, was that Downie could not consume any intoxicating substances during the six month period. He and his union contend that Downie thought the only substance covered in this ban was cannabis. The company argued that Downie was subject to duty in the day prior to the shift where he posted positive for alcohol because he was on call.

The union's successfully argued that he was not subject to duty at the time and therefore should have his position reinstated and made whole for the loss of wages and benefits minus mitigation. Well, that's an interesting journey up and down and taking a cannabis edible, what, 16.5 hours before his tour of duty? Well, we know what edibles can do and they can be a long time.

And let's throw in one more story from DragonCon, this one written by Sarah Clark, a new study from the U.S. says that the adoption of medical cannabis laws may contribute to decreases in health care costs. A new review published in the Journal of Applied Health Economics and Health Policy examined health care cost in the US states that adopted medical cannabis laws.

The authors say there was a significant decrease in the average total premium per employee for single coverage plans per year in those states that allow some form of medical cannabis access. The researchers compared these costs with states without state legal access to medical cannabis, concluding that if all people in all 50 states had legal access to medical cannabis, employers and employees could collectively save billions on health care coverage, potentially reducing health care expenditures, contributions to GDP by 0.65%.

The paper estimates that employers and employees could see combined savings of $14.9 billion a year for single coverage plans if all 50 states had legal access to medical cannabis in 2023. The US had around 4 million people registered to access cannabis for medical purposes across 38 states. The paper speculates there are likely more than that who are not captured through registration, as not all states require it.

Researchers say the impact of these changes on private health insurance costs can be seen just five years after states medical cannabis laws come into effect. The paper argues that one reason for the savings is that cannabis, which is often not covered by insurance providers, is often used instead of medications like opioids that are covered by those insurance plans.

The paper also cites different outcomes the total average premium cost per employee for single family and employee plus one health insurance plan, and the total average deductible cost for single and family health insurance plans. In addition to the 3.4% decrease in the average total premium per employee for single coverage plans per year in those states that allow some form of medical cannabis access, researchers noted a 2.5% decrease in the average total premium cost for employee plus one coverage plans.

Search Results. Search engines and GPS platforms like Google and Apple Maps give legitimacy to unlicensed cannabis businesses in California by not distinguishing them from licensed dispensaries in respect of search results. That's according to a measure that the Los Angeles County Board of Supervisors approved this week in a unanimous vote. The proposal, introduced by Supervisor Lindsey Horvath, seeks to remove illegal cannabis dispensaries from Google, Yelp and other search engine platforms, reported the Los Angeles Times.

The measure also directs several county agencies to compile reports within three months on possible actions to curb unauthorized cannabis advertising in the unincorporated areas of the county. It also says five county leaders should draft and sign a letter urging several major websites to voluntarily stop advertising illegal cannabis dispensaries in the county, regulating online search engines and GPS platforms will ensure only legal licensed dispensaries appear in results from those platforms and protect the safety of the public.

Horvath's motion stipulates the document also highlighted that Los Angeles County hosts roughly 10% of the total number of dispensaries estimated to operate nationwide, with nearly 1500 retailers. Citing Pew Research Center's data that said, data from the California Department of Cannabis Control suggests that only 384 of these dispensaries as of 2022, had a valid state approved license. The California effort to crackdown on the advertisement of unlicensed cannabis businesses follows a call from New York Governor Kathy Hochul and licensed dispensary owners in the Empire State to major social media companies like meta platforms and Alphabet to start promoting unlicensed cannabis businesses.

The governor's demands extend to digital services like Google Maps and Yelp, urging them to stop directing consumers to unlicensed vendors, as it is not only a legal dilemma, but also a public health concern due to the distribution of untested products. And while that story is about California, it obviously applies all the way across Canada, because we all know we can all go onto Google or any of our Web platforms and find any number of illicit cannabis opportunities to purchase cannabis on the Web that are not regulated stores.

So interesting to see how this works in California and whether it'll have any spillover effects up here in Canada. And as I mentioned previously, we are getting very close to the sixth anniversary of the Cannabis Potcast. To strike encore for our next story. This one written by David Brown. Cannabis sales are showing some upward movement in the first half of 2024, but increases did not surpass those previous highs in much of the first half of 2023. The annual growth of the market appears to be finding a ceiling on adjusted retail. Cannabis sales in Canada continue to rebound through July from steep seasonal declines in January, but sales were down year over year from March through July compared to 2023.

When looking at the same figures adjusted for seasonal changes, July 2024 was down almost 2% from June and almost 4% compared to July of 2023 provincially. These declines appear to have been most pronounced in Ontario, British Columbia and Saskatchewan. While price compression is likely a factor in slowing overall sales figures, price compression has been an issue facing the industry for years now, even as overall sales continue to increase.

One change in the market is that the number of new stores has been slowing in the last year, which is correlated with increased sales since legalization began. Another possible factor is the increasing number of options consumers have in the illicit market, both brick and mortar and online stores. Interestingly, after several years of declines, those registering to grow their own cannabis under designated and personal production licenses for candidates for medical purposes, or increase seen in the first half of 2024.

Despite greater oversight by Health Canada, Statcan will continue to watch these monthly sales figures as they evolve to better understand these changing market factors.
