And it is that excessive use of cannabis that has become a bit of a problem. Let me back up a little bit. So I have been diagnosed with a minor stroke over the last week or so. And in addition to that, I no longer can drive for 30 days because of the fact that I had a stroke. Now, when I decided that I still wanted to do cold work corner, it meant that I had to change the focus.

My doctor has determined that I smoke a lot of cannabis, and he thinks that that is, in fact, contributing to what's happening about my stroke and to the risks of smoking too much cannabis. And we're going to track and.com, written by David Brown, BC Court of Appeal judge is sided with a man who previously had an insurance claim denied due to a small legal cannabis grow site in his home. In a ruling posted on March 14th. The judge found that a previous court decision that sided with the man's insurance company was incorrectly interpreted, allowing the appeal.

The man had appealed an order from the Supreme Court of British Columbia from 2021 that denied his coverage. After a 2017 kitchen fire was unrelated to his cannabis grow operation. The appellant, Anthony Passato, lost his home in peatland, BC to the fire, a claim he made to his insurance provider, Gore Mutual Insurance Company, was denied due to the discovery by the insurer that the man was growing approximately 25 cannabis plants in his home.

Although the plants were authorized under a license from Health Canada and had been insured by Gore since 2014, the insurance provider denied his claim for compensation for his loss. Gore, in their denial, pointed to an exclusionary clause in the policy that did not allow cannabis cultivation on the property. Basado sued his insurer, but the judge in the case sided with the insurance company.

In the appeal, the new judge ruled that the first judge aired in their ruling, saying it was based on a previous court case, which the appeal judge said was not prevalent as they dealt with illicit cannabis production. The first of those cases involved the illicit production of cannabis extract, rather than a legal licensed medical grow operation, while the second dealt with a 300 plant operation.

But the owners made efforts to hide. But Sorrell made no such effort to hide his small group operation. In addition, even after denying his claim for a supposed breach of policy, Gore did not cancel but had his policy and continued to collect payments. Since the appellant's cultivation was not illegal, nor did it create unusual risks. The appellant could reasonably expect that an exclusion did not apply.

Wrote the honorable justice, wintering in part in their decision. I accept that the appellant did not give evidence about his expectations, but it is reasonable for an insured party to expect that an inclusion which is drafted in a way that targets illegal activity, would not apply to their illegal use of the property. The appellant was using medicinal marijuana to relieve chronic and disability treating pain experienced following back surgery, the judge continued.

He sought and obtained a license that permitted him to grow up to 73 marijuana plants. He had 25 plant at the time of the fire. While not determinative, the cause of the fire had nothing to do with his marijuana plants. As the trial judge found, and there was no suggestion that the appellant misled or misrepresented the insurer in any way.

Further, the judge relied heavily on the underwriters evidence. The Ontario case, where the same exclusion was at an issue in different circumstances. In my view, these circumstances support a finding that would be unjust or unreasonable to give effect to the exclusion. And there you go. And another insurance claim not handled.

And we picked this story up from DragonCon. This was written by David Brown. A federal court judge has dismissed an application for judicial review from a man who has argued that his cannabis seeds were unfairly seized by CBSA. In a ruling posted March 28th, 2025. The Honorable Mr. Justice a grant, dismissed an application from a man who had several hundred cannabis seeds seized by Canadian Border Services Agency upon his return from Canada from a cannabis expo in Denver, Colorado.

The man challenged the decision to seize those seeds, arguing that the seeds were not cannabis. He told the court that the 465 seeds were not considered cannabis by the seller, and are considered hemp seeds due to their lack of cannabinoids or THC. However, according to a seizure report, the CBSA officer found a small box labeled cannabis seeds and several other packets.

The boxes label also contained statements such as checklist, local laws and regulations, and some of the package contained words such as feminized or germinate, and indicated how long it would take for a seed to flower. In addition, the man, Mark Myrick, argued that the Federal Cannabis Act does not define cannabis seeds as being cannabis and that the seeds were instead classified as hemp.

The court rejected this argument as well, noting that the definition of cannabis under the Cannabis Act does not deal with distinctions between marijuana and hemp, both of which come from the cannabis plant, wrote the judge in his ruling. Having reasonably characterized the seized seeds as cannabis, it was also reasonable. Indeed inevitable, for the delegate to tell her chairman that the seeds should be held as forfeit.

As noted above, section 11 117 of the customs Act does not allow for the return of property seized cannabis. The Minister was bound not to return the cannabis seeds, and the decision to this effect was therefore reasonable, and I guess it was reasonable.

Although Canadian cannabis is not directly impacted by the emerging trade war with the U.S., many aspects of the cannabis industry supply chain could be. This can mean increased costs for producers and these costs being passed on to consumers. Well, cannabis is still not legal in the U.S..

Cannabis imports or exports between Canada and the U.S. are off the table. Well, these have been some rumblings of tariffs on Canadian cannabis being sent to Israel for the most part. Canada's actual cannabis products are not feeling the pinch of the emerging turf wars. The packaging used for these cannabis products, however, has well as some of the equipment used in the different steps of cultivation and processing can be due to the most significant cost increases for S NGL, a publicly traded company that operates in the Canadian cannabis space in both production and retail, are the cost of minor packaging and aluminum cans.

Sundial sells an array of cannabis products, from dried flower, vapes and edibles to beverages. It operates a dedicated beverage facility for both cans and bottles in Bolton, Ontario. Although most of their business on the cannabis side is not impacted, says Tyler Robson, president of Cannabis Heads, sadly, these two aspects of cannabis packaging you're already seeing cost increases and delays.

The biggest increase and biggest bottleneck for us is probably Miller Packaging, he said. With the childproof bags, we're seeing about a 15 to 20% increase, not even from tariffs, but just from recent cross-border challenges. That's one that's impacting our business in the most critical way. Now, in addition to cost increases on the finished cans they order from a manufacturer in the United States.

He says there have been increased delays in shipping and even issues securing enough supply due to increased cross-border challenges in recent months. But beyond that, to be honest, we're really not very impacted, he adds. The federal banking system doesn't allow us to do a cross border purchasing, so we don't buy too many things from the US today, it's mostly from Europe and China, so we're mitigating most of the noise coming from tariff today.

One of the challenges in terms of packaging, explains Robson, is that there are few more affordable options from manufacturers in Canada or abroad. Even with the cost increases from the US, he says, it's still exceptionally cheaper for single to source their packaging from south of the border than domestically or from Europe or Asia. Calvin Hampton, CEO, Bubble Bud Incorporated in Edmonton, which produces cannabis beverages in glass bottles, says he's already seeing a noticeable increase in his cost for bottles as well, although he sources them from a broker in Quebec.

The bottles are made in the United States, even further, highlighting the complexities modern day supply chains. He says the silica used to make the bottles can come from Canada, but that is then shipped to the US in Ohio, Illinois, before making its way back to his factory in Alberta to be filled with cannabis infused drinks. If Canada puts a retaliatory tariff on silica, the price for the manufacturer will rise.

Then he'll be tariff on what finished product coming back into Canada. We searched far and wide for a Canadian company that could meet the volume, the pricing and the timescale required to an industrial plant without having huge warehouses of buffer material. Instead, he says, he's now looking for getting supply from Europe, but expects this could be even more of a cost increase.

This is also an issue he thinks some companies may not want to admit yet, especially if they have to take into account investor interest and concerns. Most cannabis companies don't want to admit that they're seeing cost increases everywhere, because most aren't operating on great margins. Not everyone is feeling the pinch, though. Raj Grover, founder and CEO of High Tide, which operates not only a large cannabis retail chain in Canada but also various e-commerce sites in the US, says the majority of its products are not impacted by the trade issues with the U.S., despite the trade war threats to the broader North American economy.

Our underlying fundamental business is insulated from supply chain impacts as 99% of the sales we generate in Canada and the U.S. don't cross the border. Keith Bo, managing director at Aveo, a company that sells vape hardware to cannabis companies, says that since their products primarily come from China, they have not seen any associated cost increases due to tariffs or other trade restrictions.

The current trade wars do not impact vape hardware. Currently, the majority of the manufacturers are from China, and there has been a further increase of tariffs in the U.S. for vape hardware. In Canada, nothing has changed. We still pay importing customs, which equals to 5% of the GST. Still, he says, consumers will likely see an increase in vape prices as it into a direct result of the U.S. government's trade war with Canada under the Trump administration, as well as increased prices of Canadian cannabis inputs.

This will not be due to the ongoing trade war, climate or tariffs, Powell explained. This is due to supply and demand and are weak. Canadian dollar flower. Trim and input materials are going up in cost due to less cultivation and more demand than previous years, and the only currency China accepts is U.S. dollars. And there's an expensive cost to convert Canadian dollars to U.S. dollars.
