This just gets better and better. Is it running a legal cannabis business in Canada? Wasn't difficult enough. Some producers are now discovering that even being the victim of a crime doesn't spare them from government taxation. An emerging concern across the industry is that licensed producers are being charged excise tax by the Canada Revenue Agency on cannabis products that were stolen before they ever had a chance to be sold.

Dylan King, CEO of British Columbia based craft cannabis company Pistol in Paris, experienced this firsthand when his facility was robbed in July 2023. We had a break in at our facility and they stole 130kg of cannabis. The thieves got away and it was me taking the hit because we weren't insured at that time. It was a big loss for us, he recalls.

In the aftermath, King did what many businesses would do. Upgraded security and secured insurance for future protection. We made the best of the situation by beefing up security and adding insurance on our product. But several months later, his company received a surprising bill not from a vendor or supplier, but from the CRA itself. Fast forward about eight months.

My accounting office got a bill from the C.r.a. Excise Tax Department for $130,000 for lost excise revenue, he says. I told my accountant there must be some sort of mistake. It was an exercise. If it wasn't packaged, it was just for cannabis. And I had determined whether I was going to sell it internationally or in Canada. Despite the product never entering the retail system, the C.r.a. maintained that the company was viable.

According to King, the agency's position was based on the belief that the stolen cannabis was destined for the Canadian market. They said due to the theft in Paris, is still liable for $130,000 in excise. King's initial appeal was rejected. He's now in the second stage of the appeal process, though CRA collections have already begun. We drafted a really good letter to them saying that this bill might cripple the business and shut my facility down.

I also reminded them that we pay. We've never been late and we've never had any issue paying our excise tax, he explained. It's just such a frustrating battle to fight. Trying to prove to them why this is a dangerous position for me. Well, the regulations are clear in some areas. They're far less forgiving in this scenario. Trina Fraser, a partner at Brazeau Seller Law, notes that excise duty on lost or unaccounted for products is not unique to cannabis.

It exists across several regulated goods. The concept of excise duty being paid for goods that cannot be accounted for, does extend beyond cannabis to other goods that attract excise duty, she said. Setting specific sections of the excise Act in 2001, Fraser pointed out that includes bulk spirits, package wine, vaping products and tobacco. However, Fraser added that other products are granted exceptions that cannabis is not.

There were several exemptions that apply to other types of goods which do not apply to cannabis. For example, the penalty for unaccounted tobacco and vaping products doesn't apply when the goods were destroyed by fire and the penalty for unaccounted bulk spirits package. Spirits and wine doesn't apply where the goods were lost in prescribed circumstances. Fraser says theft is typically not one of those exceptions for any product if it occurs within a facility rather than during transport.

Still, she believes these CRA should show more flexibility or that the law could be updated. It might discussions with CRA. Their position seemed to be that the license holder is ultimately responsible for the products, and they must do everything necessary to prevent loss or theft, she explains. I believe this releases Cra's belief that stolen product will likely make its way into the regulated illicit market, and Cra's position is that duty should still be payable in this circumstance, she adds.

CRA has also advised me that if the cannabis industry believes that circumstances should be prescribed where license holders should be absorbed, the responsibility for lost or stolen cannabis products, then industry needs to advocate for legislative changes to the act. To provide for this. Sherry Woodrum, CEO and co-founder of Delta Incorporated, agrees that the Cras interpretation is legally grounded but also believes it raises serious questions of fairness and logic.

From a regulatory standpoint, the Cra's position of holding license holders liable for excise tax on solely cannabis products is a matter of the language constraint in the Excise Act 2001, which treats the product as dutiable the moment it is packaged and stamped for sale, she says. The rationale is that once the product enters the duty paid stream, it is presumed to be destined for the consumer market, and excise duty is therefore payable regardless of whether the product is ultimately sold, destroyed or lost due to theft.

However, Woodrum emphasizes that this logic fails to consider the real world consequences for license holders already struggling with narrow margins and complex compliance demands. Applying excise tax to stolen inventory not only punishes the victim of a crime, but also fails to account for the product's removal from the commercial supply chain, essentially taxing a lot. She suggests that a more balanced system would recognize theft as a legitimate and verifiable loss, much like how destroyed products are sometimes treated.

There is a case to be made for more nuanced approach, such as allowing for relief where theft or loss is documented and sufficiently investigated, she explains. Similar to the cra's treatment of destroyed products, under certain conditions, the producer may be eligible to apply for a remission of the excise tax already paid on those units. As a publication, Dylan King is still awaiting a decision on his second appeal, a resolution that could determine the future viability of his company.

In the meantime, his story stand as a warning to other cannabis businesses. Being robbed may not be the end of your problems. It might be the start of a tax bill. Now, that's probably something nobody ever thought that they were going to be taxed on stuff that had been stolen from their inventory.

We're picking this story up from Strack and Akam, and this is all about a story that we have already covered a couple of times on the fact that Alberta is looking to sell cannabis at public events. Cannabis retailers in Alberta can sell cannabis at events and festivals where minors are permitted. An announcement from the Alberta Gaming, Liquor and Cannabis Commission, the AG CLC, shared with the industry the week of July 14th, states that cannabis store licenses can now apply for a license to sell cannabis at events, even if minors are permitted to attend.

This most recent change follows a similar change to the province's rules in 2024 that allowed such sales as minors, prohibited entertainment events or cannabis industry trade shows. The province has also previously allowed cannabis consumption spaces at these types of events. Previously, cannabis sales in Alberta were restricted to adults only 18 plus events. Retailers could sell cannabis only, with the temporary license extension from the AG.

CLC, and sales could not occur within designated consumption areas. The amended policy related to these sales may be found under section 4.17 of the Agco, LLC's Retail Cannabis Store Handbook. One Alberta cannabis retailer says it is already taking advantage of such changes, with pop up sales at at least two events this summer. Plant Life Cannabis, with about 40 locations in Alberta, was selling cannabis at the Rock and Thunder in Edmonton on the weekend of July 11 to 12, and will be at Country Thunder in Calgary from August 15 to 18.

Cannabis sales take place in an 18 plus area. The event Rocking Thunder, included bands like Def Leppard, Joan Jett and Weezer, while Country Thunder features artists like Cody Johnson, Bailey Zimmerman and Clint Black. We see this is a natural evolution where cannabis retail is headed, said Ian Scott, VP of operations for Plant Life Cannabis Festival is bring together a wide range of Albertans and by operating in designated 18 plus zones with transparency, education and full compliance.

This sets a new benchmark for what's possible in the evolving entertainment and cannabis landscapes.

Scott tells Stratton that the company, along with others in the industry, worked with the Anglesea in the lead up to the announcement, allowing them to plan these two events in anticipation of these regulatory changes. Alberta is the first province to allow these types of sales at Non-Targeted events. This is a huge step for the normalization of cannabis in Alberta, added Marty Kislyak, president of Retail Plant Life Cannabis.

Gerry Korczak, director of corporate partnerships at Rock and Thunder and Country Thunder, said the first event went well. We're also happy to have this partnership lined up for our Country Thunder event in Calgary this August. Ivan Ross Vrana, a consultant with Diplomatic Consulting, which helped work with the provincial regulator to push for these types of changes, says he sees it as a step forward for the entire industry. With Alberta leading the way. Toronto, who also works with Alberta based cannabis event company called Positive Event Event, which hosted one of Canada's first adults only alcohol free festival, Cannabis Consumption Gardens at the 43rd annual Edmonton International Fringe Theater Festival in 2024, says he expect to see many other such events and partnerships of all kinds in Alberta later this year and next.

He also sees this as a chance for other provinces that are looking into similar allowances to learn from Alberta's approach. The B.C. government, he points out, as an example, has been undertaking industry consultations to allow sales of events as well. We really want to push the envelope of what is possible under this new allowance, and we think it's a giant step forward for cannabis to be normalized with a new population base.

I think we will see more of these events this year and especially next year. I think there's clarity here in Alberta is going to be more common, says Vrana. The B.C. government recently issued a discussion paper contemplating cannabis sales at events as well, something Verena says has a chance to be influenced by Alberta's leadership on the file. Manitoba enters gacha and have also allowed sales at events in some limited capacity.

In 2022, producer Western Cannabis, in collaboration with cannabis distributor Weed Pool and retailer Wild Boutique, operated a retail sales booth, the first of its kind in the province. At Country Thunder, a four day festival. Casey Bear, the director of operations at Chinook Cannabis and the co-founder of The Garden, which provides cannabis gardens for events, tells Stewart that, you know, just recently hosted a space at Badlands, something the company has done for several years now.

It was those events that were the catalyst to get this legislature changed to allow for minor allowed events, he says. This is great for the entire cannabis industry in Alberta, says bear. The reaction from the public has been super positive. Cannabis has always been at these events, so this is just allowing it to be done more compliantly and that's a great news from Alberta.

Unfortunately, these terpene can degrade easily in cured flowers through improper storage, handling, and exposure. Light. Any discussion about turbines should also touch on cannabinoids. Terpenes and cannabinoids, including THC and CBD. Both contribute to the effect of cannabis when consumed. Both bind with receptors in the brain to produce an overall effect in our bodies, including the euphoric high most people seek from the cannabis experience.

The medicinal benefit from the interactions of chirping and cannabinoids, warrants continued study. Some cannabis patients favor the results of whole cannabis flower therapy over synthetic cannabis concentrates, such as distillates, which remove natural terpenes. Suffice it to say, the cannabinoid terpene relationship is both fascinating and complex. But turbines alone will be the focus here, and there's plenty to discuss.

Although cannabis contains more than 40 types of turbines, only about a dozen are common, and we'll focus on the most relevant of those. Turbines produce their therapeutic benefits by interacting with the endocannabinoid system. In 1988, two cannabinoid scientist has been Chabot and Rafael. Mushroom discovered that cannabinoids, terpenes, and flavonoids can work together to create a synergistic healing effect.

Simply put, when you consume a cannabis extract that is full spectrum, you are likely to experience a healing effect that is stronger and will last for a longer time through the effect of symbiosis.
